We do not normally give refunds if you:

  • simply change your mind, or
  • make a wrong decision.

You can choose between a refund, exchange

or credit where goods:

  • are faulty
  • have been wrongly described
  • are different from a sample shown to you, or
  • do not do what they are supposed to.
Please retain your receipt as proof of purchase  

REFUNDS - Please choose items carefully, should you change your mind on a purchase, any exchange or return or refund will be at the discretion of Etching House.

Etching House operates under a fair mind and commonsense policy.

Any items being returned must have written permission from Etching House,

Etching House reserves the right to recoup or retain any out of pocket expenses.

A restocking fee may apply and is limited up to 20%;

Postage and Shipping will not be refunded and is not included in the restocking fee.

Any items approved for return or exchange must be in good order and condition.

Damaged Items - Please Note Items purchased are checked by Etching House very carefully for condition before being sent, items are packed very well and in accordance with specifications set by the shipping companies or carrier appointed by Etching House.

Caution handling items by Customer or representative - Customers who receive items unframed should refrain from opening the packaging or handling unframed items unless experienced, and if experienced they are only to use white cotton gloves. We suggest the customer leaves the unpacking of an item to there nominated professional framer or curator.

We recommend that customer before signing for items being delivered check the packing for any signs of damage, if damage is found please note it, take digital images even by phone if needed, make notes of time and place etc on the delivery copy of the carrier's docket, and contact Etching House immediately, or do not accept the item from the delivery service.

Etching House reserves the right to replace the item, if available, or provide a refund at no cost to the customer, providing it is not a customer specified shipping method.

Defective Items - Etching House will provide a refund for defective items and there shall be no cost to the customer should an item be found to be genuinely defective due to, manufacturing fault, material fault, faulty workmanship. Any claim arising from such matters will be limited to and by that provided by the Artist, Printer, and material manufacturers.

Any Claim shall be limited to the money paid for the item; Etching House reserves the right to replace the item at no cost to the customer, providing the item is available.

Etching House takes all care but accepts no responsibility for defective items or consignment stock.

Consignment Stock, Etching House takes all care but accepts no responsibility for items left on consignment, it is the responsibility of the vendor or owner to provide adequate insurance cover, Etching House takes all care but accepts no responsibility, and accepts no claims for damage or loss for items left with Etching House.

Cancelation of an order outside the Lay Buy program -

Cancelation of an order is accepted providing no payment has been received by Etching House.

Cancelation of an order after payment has been received by Etching House-

Cancellation request being accepted is at the discretion of Etching House and in most cases may not be accepted if funds have been received and shipping has commenced, meaning the goods have been wrapped and commenced with being sent.

At all times Etching House reserves the right to retain any reasonable expenses incurred associated with the direct need of Etching House to full fill and expedite the paid order placed, these expenses are related to courier fees, shipping costs, return shipping costs packing materials, wrapping time and effort, administration costs, bank fees if applicable, these general costs are referred to as Cancelation Fee.

Cancelation of order after payment has been received, for items ordered in to stock especially for the customer - Any restocking fees and reasonable directly associated costs for the order to be implemented shall be paid by the customer.

 If the items ordered especially for the customer can not be returned to the supplier then cancelation of an order will not be accepted.

ETCHING HOUSE LAY BY PLAN, OR PAYMENT PLAN.

Please Note: the term Lay Buy Plan is used for the purpose of easy recognition, the plan offered is the "Etching House Payment Plan" here in may be referred to as - Lay Buy or Lay By Plan.

WHEN COMMENCING A LAY BY YOU SHOULD CHOOSE GOODS CAREFULLY, STAY WITH IN YOUR MEANS AND BE RESPONSIBLE IN HONOURING YOUR COMMITMENTS.

THE LAY BY PROGRAM IS INTENDED TO BE A ETCHING HOUSE SERVICE, ANOTHER CHOICE OR MEANS TO WHICH A CUSTOMER MAY PURCHASE ART AND SAVE ON INTEREST CHARGES COMMONLY FOUND WITH CREDIT CARDS, IT IS A SERVICE THAT MUST BE ENTERED INTO ONLY WHEN AND IF YOU ARE HAPPY WITH YOUR SELECTION AND YOUR LEVEL OF COMMITMENT TO PAYMENTS, AND THAT YOUR ABLE TO AFFORD IT WITH OUT SUCH COMMITMENT BEING A BURDEN ON YOUR BUDGET. COMMON SENSE SHOULD BE USED AT ALL TIMES.

IN THE EVENT OF MULTIPLE ITEMS BEING PLACED ON LAY BY, YOU CAN COLLECT EACH ITEM AS IT IS PAID OFF, YOU CAN ADD TO YOUR LAY BE AT ANY TIME.

 

GENERAL LAY BY TERMS AND CONDITIONS,

ETCHING HOUSE reserves the right to - Accept or reject any application or request for a Lay buy or payment plan program.

THE ETCHING HOUSE PAYMENT PLAN MEANS -

The goods are selected and agreed upon,

The dollar amount is agreed to,

The term is agreed to,

The payment rate has been considered carefully by the customer,

The terms and conditions have been accepted on this web site, in all correspondence verbal or written, Acceptance of this Plan and purchase is considered to be when a deposit payment is made.

 A deposit is paid, and the payments are paid till the full amount is paid with in the term or time nominated, upon the full amount being paid arrangements will be made for delivery or collection of the items.

2. THE BUYER - is the customer or buyer or person responsible for the Lay By payments and commitments.

3. THE VENDOR - is Etching House who is providing the items owned or represented by Etching House.

4. THE ITEMS - are the items chosen by the buyer and supplied by the Vendor, such items may be - NEW, SECONDARY (pre owned), REFURBISHED, REPAIRED, AND SOLD IN AS IS CONDITION.

5. TERM - is the time or period agreed to which the Lay By- payment plan will run. No Lay by term shall exceed duration of 12 months. The start and completion time will be discussed and agreed upon by both parties before commencing, AGREEMENT BETWEEN BOTH PARTIES MEANS WHEN A DEPOSIT HAS BEEN MADE AND ACCEPTED.

6. REGULAR PAYMENT - MEANS the level of payments shall be estimated, and shall be enough to see the Lay By paid off over the agreed Duration. The general method to determine payments is -

EXAMPLE if you are paying off $1500 over 3 months it's a minimum of $500 per month, if you are paying off $10,000 over 10 months its $1000 per month.

Payments may vary to suit personal budgets, how ever it's important to note that if no payments are received for 3 consecutive months, the Lay By may be considered to be in breach of the agreed Lay By program there for in default, see REMEDY SECTION 12 below.

7. GUARENTEE

IS APPLICABLE TO NEW ITEMS ONLY AND LIMITED TO THAT GIVEN BY THE MANUFACTURER OF MATERIALS OR ITEMS, PRINTER, ARTIST, WHOLESALER, ORIGINATOR, FRAMER ETC, ETCHING HOUSE GIVES NO GUARENTEE WHAT SO EVER.

2. GUARENTEE - PREOWNED OR SECOND HAND GOODS ARE SOLD IN AS IS CONDITION, NO GUARENTEE IS OFFERED.

8. DISCLAIMER - UNDER NO CIRCUMSTANCES WHAT SO EVER IS ETCHING HOUSE - LIABLE OR RESPONSIBLE FOR GOODS NEW OR USED THAT ARE DEFICIENT, FAULTY OR CAUSE DAMAGE OR HARM TO PERSONS OR PROPERTY. ETCHING HOUSE WILL NOT ACCEPT ANY CLAIMS MADE FOR DAMAGES OR COMPENSATION WHAT SO EVER.

9. BUYER LAY BUY FINANCIAL DIFFICULTY- It is up to the Buyer to inform Etching House in writing to PO Box 408 Camden or by PHONE if the Buyer is in financial difficulty and unable to continue with the Lay By, in this case the Lay By will be considered to be in default, Etching House will endeavour to work with the Buyer to best resolve matters, however default AND REMEDY conditions in 11 and 12 below will apply.

10. DEFAULT - Means - The Buyer not completing payments within the agreed duration, or the buyer not making enough regular payments, or the buyer giving Etching House written notice cancelling the lay by at any time.

11. REMEDY and DEFAULT REMEDY of a Lay Buy -

In the event of the Buyer being in default of, or, cancelling the Lay Buy, Etching House will be entitled to retain a restocking fee from any money paid to date by the Buyer; this is called a restocking fee which will apply as follows

- A Lay Buy not exceeding the duration of 120 days, a 20% restocking fee applies

- A Lay Buy exceeding the duration of 120 days, a 25% restocking fee applies.

- If payment amount received to date is more than the 20 or 25% restocking fee, Etching House will have the right to, pay back to the customer any amount paid to date excluding the restocking fee, or Etching house may elect to with hold any refunds, until such times Etching House sells the item that was on lay buy, then refunding the customer to the appropriate amount paid to date less restocking fee.

All attempts will be made to sell the item in a reasonable and timely manner by Etching House.

12. TERMINATION OF LAY BY- MEANS - Etching House has the right to terminate the Lay By if the Buyer is in default of the Lay By, in which case Etching House has the right to:

Etching House may choose to sell the items on Lay by FIRST in order to obtain the funds necessary for the purpose of refunding money due to the Buyer less restocking fee out lined in this section.. (d) Etching House will endeavour to obtain a fair market price with in a reasonable and timely manner.

13. Goods on Lay By will not be released until fully paid for.

NOTICES - of termination or default notice of a Lay By from Etching House, Written notice will give a minimum 30 days written notice by mail or email to the last known address of the buyer, Etching House will make contact by Phone and confirm by email such attempted contact. Etching House will make all reasonable attempts to resolve the matter in a timely manner, it is the intention and will for Etching House to refund any money received from the customer as long as Etching House is not out of pocket with fiancé costs, administration costs, Etching House reserves the right in some cases to sell the default item for and on behalf of the Customer in order to minimise a cash flow impact on Etching House.

15. Etching House will take all reasonable care to ensure goods selected for lay by are kept safely  and made available for collection at the completion of a Lay By, however Etching House reserves the right that in the event the items on Lay By are damaged, lost or stolen and therefore no longer available by Etching House, its agent or supplier, Etching House shall be limited to refund only the amount received from the customer to date for that Lay By, or Etching House will have the option to replace it from elsewhere if possible, or with the permission of the buyer provide other goods or items to the same value . No claims shall be made on Etching House what so ever.

A fair mindedness and commonsense should prevail at all times.

16. Commonsense shall prevail at all times - both the Buyer and Etching House will at all times endeavour to uphold the spirit of the Lay By in an amicable and reasonable manner and neither party shall gain or make un warranted profit from a default situation arising.

17. Any matters unresolved will be dealt with under the laws of NSW

ETCHING HOUSE DISCLAIMER

Etching House takes all care but no responsibility for accidents or damage to goods or persons or property arising from any purchase of artwork or services from Etching House.

Choose your items carefully and check before hanging, we recommend you have a professional installer hang your framed art work so all safety matters can be checked, we sell our second hand - pre owned unframed or framed pictures in as is condition.

Etching House makes no guarantee or offers assurances for speculative price gains or capital growth for any artwork, or claims that art work will appreciate, any indications made are purely based on market information available at the time as well as any historical information that may be available, market forces will determine prices as will supply and demand. Etching House points out that like with any items being sold new or pre-owned there are selling costs associated and one should budget accordingly if considering selling, we also recommend the buyer/seller doing adequate market research before proceeding with any purchase/or sale.
